Decree by which Article 10 [2nd] is added to the General Law of Health

Único. - Se adiciona el artículo 10 Bis de la Ley General de Salud, para quedar como sigue:

Only. - Article 10 Bis of the General Health Law is added to read as follows:

ARTÍCULO 10 BIS. El personal médico y de enfermería que forme parte del Sistema Nacional de Salud, podrán ejercer la objeción de conciencia y excusarse de participar en la prestación de servicios que establece esta ley.

ARTICLE 10 BIS. The medical and nursing personnel that form part of the National Health System may exercise conscientious objection and excuse themselves from participating in the provision of services established by this law.

Cuando se ponga en riesgo la vida del paciente o se trate de una urgencia médica, no podrá invocarse la objeción de conciencia, en caso contrario se incurrirá en la causal de responsabilidad profesional.

When the life of the patient is put at risk or if it is a medical emergency, conscientious objection cannot be invoked, otherwise the cause of professional responsibility will be incurred.

El ejercicio de la objeción de conciencia no derivará en ningún tipo de discriminación laboral.

The exercise of conscientious objection will not result in any type of employment discrimination.

Transitional

Primero. El presente Decreto entrará en vigor al día siguiente de su publicación en el Diario Oficial de la Federación.

First. This Decree will come into force on the day following its publication in the Official Gazette of the Federation.

Segundo: La Secretaría tendrá un plazo de 90 días naturales posteriores a la publicación de este Decreto para emitir las disposiciones y lineamientos necesarios para el ejercicio de este derecho en los casos que establece la ley.

Second: The Secretariat will have a period of 90 calendar days after the publication of this Decree to issue the necessary provisions and guidelines for the exercise of this right in the cases established by law.

Tercero: El Congreso de la Unión y las legislaturas de las entidades federativas en el ámbito de sus respetivas competencias, realizarán las modificaciones legislativas, conforme a lo dispuesto en el presente Decreto, dentro de los 180 días naturales siguientes a su entrada en vigor.

Third: The Congress of the Union and the legislatures of the federal entities within the scope of their respective competences, will make the legislative amendments, in accordance with the provisions of this Decree, within 180 calendar days following its entry into force.

Cuarto: Las acciones que se generen con motivo de la entrada en vigor del presente Decreto, se cubrirán con los recursos financieros, humanos y materiales con los que actualmente cuente la Secretaría de Salud.

Fourth: The actions generated by the entry into force of this Decree, will be covered with financial, human and material resources that currently have the Ministry of Health.
